Gareth Henry and Simone Carline Edwards v. Jamaica (IACHR)

Published on 17 February 2021, this decision by the Inter-American Commission on Human Rights comes in response to a case supported by the Human Dignity Trust, challenging the criminalisation of same-sex activity in Jamaica. Significantly, the Commission urges the Jamaican government to repeal the sections of the Offences Against the Persons Act that criminalise consensual sexual conduct between men, and to ensure measures are in place to prevent, investigate and punish incidences of violence against all LGBT people. As the first-ever decision of the Commission to find that laws criminalising LGBT people violate international law, this is now the landmark LGBT human rights case for the entire Caribbean region.
