Niue (Sexual Offences) Amendment Act 2024

In May 2024, the Niue Legislative Assembly removed the offences of ‘buggery’, ‘attempted buggery’, and ‘indecent assaults on males’ from the Criminal Law Code.

In May 2024, the Niue Legislative Assembly passed the Niue (Sexual Offences) Amendment Act, which came into force the following month. The Act amends the Niue Act 1966, replacing several provisions on sexual offences that are reproduced in the Criminal Law Code. Notably, it repeals sections 170 and 171 (corresponding to sections 43 and 44 of the Criminal Law Code), removing the offences of ‘buggery’, ‘attempted buggery’, and ‘indecent assaults on males’, and replaces them with offences relating to bestiality and attempted bestiality.
